Privacy Policy — Arcadian Media

1) Scope & Who This Policy Covers

2) Information We Collect

a) Information you provide directly

b) Information collected automatically

When you use the Services, we and our service providers may automatically collect:

  • Device/usage data (IP address, browser type, pages viewed, referring/exit pages, timestamps)
  • Approximate location (derived from IP address)
  • Cookies and similar technologies to remember settings and analyze usage (see Section 7)

c) Information from third parties

We may receive limited information from distribution partners (e.g., ecommerce or audiobook platforms) where the partner is permitted to share it with us, as well as from analytics and email service providers. We do not receive your full payment card details from these partners.

d) Sensitive and special categories

We do not intentionally collect biometric identifiers, government‑issued identification numbers, or precise geolocation via the Services. If we ever deploy biometric technology at any physical location or event, we will provide required notices and will not sell biometric information. We do not intentionally collect information from children under 13 (see Section 11).

3) How We Use Information

We use information to:

  • Provide, operate, secure, and improve the Services
  • Respond to inquiries and provide customer support
  • Send administrative communications and—where permitted—marketing communications (you may opt out at any time)
  • Personalize content and measure engagement
  • Manage contests, surveys, and similar features
  • Detect, prevent, and investigate security incidents, fraud, spam, or abuse
  • Comply with legal obligations and enforce our terms

We may de‑identify or aggregate information and use it for any lawful purpose.

4) How We Share Information

We share information as reasonably necessary with:

  • Service providers (hosting, analytics, email delivery, ecommerce/order fulfillment, security, customer support) under contracts that limit their use to providing services for us
  • Affiliates under the Arcadian brand family for administrative purposes consistent with this Policy
  • Legal and safety recipients when required by law or to protect rights, safety, and security
  • Successors/assigns in the event of a reorganization, merger, or asset transfer

We do not sell personal information. We also do not share personal information for cross‑context behavioral advertising as defined by certain state privacy laws. If this changes, we will update this Policy and provide any required notices.

5) Your Choices

  • Emails: You can unsubscribe using the link in our emails or by contacting us. We may still send you non‑marketing messages (e.g., order updates).
  • Cookies/Tracking: See Section 7 for controls. You can also adjust browser settings to block or delete cookies. Some features may not function properly without cookies.
  • Access/Correction/Deletion: You may request access to, correction of, or deletion of your personal information by emailing hello@arcadianmedia.com. We may take steps to verify your request and we may deny requests where permitted by law (for example, to comply with record‑keeping obligations or to complete transactions).

6) Data Retention

We retain personal information for as long as needed to provide the Services, comply with legal obligations, resolve disputes, enforce agreements, and for other legitimate purposes. Retention periods vary based on the type of data and our obligations (for example, order records may be kept for tax/reporting purposes).

7) Cookies & Similar Technologies

We and our service providers use cookies, pixels, and similar technologies to enable core features (e.g., session management), remember preferences, and analyze usage to improve the Services. You can control cookies through your browser settings. We currently do not respond to “Do Not Track” signals because there is no consistent industry standard for compliance.

8) Analytics & Advertising Partners

We may use analytics services (for example, Google Analytics) to help us understand how users interact with the Services. These providers may set their own cookies or read existing cookies and collect information about your use of the Services. We use this information to maintain and improve our Services and content. You can learn more about managing Google Analytics cookies and controls via Google’s user tools.

We do not run interest‑based advertising across third‑party sites from our Services. If we add advertising technologies in the future, we will update this Policy and provide any required choices or notices.

9) Security

We maintain administrative, technical, and physical safeguards designed to protect personal information against accidental, unlawful, or unauthorized access, destruction, loss, alteration, disclosure, or use. These measures include access controls, employee training, vendor management, and secure disposal practices. No method of transmission or storage is fully secure; we cannot guarantee absolute security.

10) Data Breaches & New York SHIELD Act

We comply with New York’s data security and breach‑notification laws. If a breach of security involving the private information of New York residents occurs, we will provide notification without unreasonable delay and within 30 days of discovery, subject to lawful delays for law‑enforcement needs. Where required, we will also notify New York state agencies (including the Attorney General, the Department of State Division of Consumer Protection, and the State Police) and, when applicable, consumer reporting agencies. We maintain a written incident‑response process consistent with our legal obligations.

11) Children’s Privacy

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information without appropriate consent, please contact us, and we will take appropriate steps to delete such information.

12) Email and Text Communications

  • Email: We follow applicable laws for commercial email. Our emails include an unsubscribe mechanism and our valid postal address. You may opt out of marketing at any time.
  • Texts/Calls: We do not send marketing text messages without your prior consent. If you opt in to receive texts, you may opt out at any time by replying STOP. Message and data rates may apply.

13) Third‑Party Links & Social Features

The Services may contain links to third‑party websites, services, or social features. We are not responsible for the privacy or security practices of those third parties. We encourage you to review their privacy policies.

14) International Users

We are based in the United States and process information in the U.S. If you access the Services from outside the U.S., you understand that your information may be transferred to, stored in, and processed in the U.S. by us and our service providers.

15) Changes to This Policy

We may update this Policy from time to time. When we do, we will post the updated version on this page and revise the “Effective Date” above. For material changes, we will provide additional notice as required by law.
